Terms of Service

1. Acceptance of Terms

By accessing and using TigerGate's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the terms of this agreement, you are not authorized to use or access the TigerGate platform.

2. Description of Service

TigerGate provides an open-source, runtime-native compliance and security platform that integrates with compliance platforms (Vanta, Drata, Secureframe) while collecting compliance evidence directly from kernel/runtime via eBPF.

Our services include but are not limited to:

  • Code scanning (SAST, SCA, Secrets, IaC)
  • Cloud security posture management (CSPM)
  • Runtime security monitoring with eBPF
  • Attack surface management
  • Compliance automation
  • Vulnerability management

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify TigerGate of any unauthorized use of your account.

4. Data Collection and Usage

TigerGate collects metadata about security events (process names, file paths, network connections, user IDs) but never collects application data, file contents, or personally identifiable information from your runtime environments. For complete details, please see our Privacy Policy.

5. Open Source License

TigerGate is open source software. The source code is available under the Apache License 2.0. While the platform is open source, certain enterprise features and hosted services may require a commercial license.

6. Subscriptions, Fees, and Payment

Certain features of the service require a paid subscription. Fees are billed in advance on a monthly or annual basis and are non-refundable except as required by law or as expressly stated in your order form. We may change subscription pricing with at least thirty (30) days' notice; price changes take effect at the start of your next billing cycle.

  • Free trials automatically expire at the end of the trial period unless converted to a paid plan
  • Late payments may result in suspension of access to paid features
  • You are responsible for all applicable taxes, duties, and government assessments (excluding taxes on our income)
  • Downgrades take effect at the end of the current billing period

7. Customer Data and Ownership

You retain all rights, title, and interest in and to your data, including source code, cloud configurations, scan results, and runtime telemetry ("Customer Data"). You grant TigerGate a limited, non-exclusive license to process Customer Data solely to provide, secure, and improve the service.

Upon termination of your account, we will delete Customer Data within ninety (90) days, except where retention is required by law. You may export your scan results and findings at any time via the dashboard or API.

8. Intellectual Property

The TigerGate platform, including its software, design, trademarks, logos, and documentation, is owned by TigerGate and its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the rights expressly granted in these Terms or under an applicable open source license, no rights are granted to you.

9. Confidentiality

Each party agrees to protect the other party's confidential information with at least the same degree of care it uses to protect its own confidential information, and not less than reasonable care. Confidential information includes non-public business, technical, and security information disclosed in connection with the service, including vulnerability findings and scan results.

10. Service Levels and Support

We target 99.9% monthly uptime for the hosted platform, excluding scheduled maintenance windows announced in advance. Support is provided according to your subscription tier. Enterprise customers may have additional service level commitments defined in a separate agreement.

11. Third-Party Services and Integrations

The service integrates with third-party platforms such as GitHub, GitLab, Bitbucket, AWS, GCP, Azure, Slack, Jira, and compliance platforms. Your use of those services is governed by their own terms, and TigerGate is not responsible for third-party services. Credentials you provide for integrations are encrypted at rest and used only to perform the scans and integrations you configure.

12. Acceptable Use

You agree not to use the TigerGate platform to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Distribute malware or malicious code
  • Attempt to gain unauthorized access to systems
  • Interfere with the service or servers
  • Scan systems or infrastructure you do not own or have permission to test

13. Disclaimer of Warranties

TigerGate is provided "as is" without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. TigerGate does not warrant that the service will be uninterrupted or error-free.

14. Limitation of Liability

In no event shall TigerGate be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

15. Indemnification

You agree to defend, indemnify, and hold harmless TigerGate and its officers, directors, employees, and agents from any claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the service in violation of these Terms, applicable law, or third-party rights — including scanning systems you do not own or are not authorized to test.

16. Export Compliance

You may not use or export the service in violation of U.S. export laws and regulations, or applicable sanctions programs. You represent that you are not located in an embargoed country and are not on any restricted-party list.

17. Modifications to Service

TigerGate reserves the right to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. TigerGate shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the service.

18. Termination

TigerGate may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms of Service.

19. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

20. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the platform at least fourteen (14) days before the changes take effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.

21. Severability and Entire Agreement

If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with any order forms and our Privacy Policy, constitute the entire agreement between you and TigerGate regarding the service and supersede all prior agreements.

22. Beta and Preview Features

From time to time, we may make beta, preview, or early access features available to you. Beta features are provided for evaluation purposes, may contain bugs or errors, and may be modified or discontinued at any time without notice. Beta features are provided "as is" and are excluded from any service level commitments and support obligations.

23. Feedback

If you provide suggestions, ideas, or feedback about the service, you grant TigerGate a perpetual, irrevocable, worldwide, royalty-free license to use that feedback for any purpose, including improving the platform, without any obligation or compensation to you.

24. Publicity

With your prior written consent, TigerGate may identify you as a customer and use your name and logo in marketing materials, customer lists, and case studies. You may revoke this consent at any time by contacting us, and we will remove your name and logo from future materials within a reasonable period.

25. Force Majeure

Neither party shall be liable for any failure or delay in performance (other than payment obligations) caused by circumstances beyond its reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, government actions, internet or utility failures, or denial-of-service attacks.

26. Assignment

You may not assign or transfer these Terms, in whole or in part, without TigerGate's prior written consent. TigerGate may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets. Subject to the foregoing, these Terms bind and benefit the parties and their respective successors and permitted assigns.

27. Notices

We may provide notices to you via email to the address associated with your account, through the platform dashboard, or by posting on our website. Notices to TigerGate must be sent to [email protected] or to our mailing address listed below. Notices are deemed received one business day after email delivery or five business days after mailing.
